Introduction

These Terms and Conditions (the "Terms") govern your use of the DesiPlate mobile application and the website at https://desiplate.kriva.studio. DesiPlate is owned and operated by Lasyaa AI Tech Pvt Ltd (referred to in this document as "we", "us", or "our").

By downloading, installing, accessing, or using DesiPlate in any way, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

DesiPlate is currently in a beta stage. Features, pricing, and these Terms may be updated as the product matures. Continued use of the Service after changes are made constitutes your acceptance of the updated Terms.

Eligibility

You may use DesiPlate if you are at least thirteen years old, or older if the laws of your country set a higher minimum age for using digital services. By using DesiPlate, you confirm that you meet this minimum age requirement.

If you are using the Service on behalf of someone else, such as a minor under your care, you confirm that you are authorised to do so and that you accept these Terms on their behalf.

You also agree to use DesiPlate in compliance with all applicable laws in your country.

What DesiPlate Is

DesiPlate is a nutrition tracking application designed for people who eat South Asian food. The Service helps you log meals, understand your nutrition, track your macro and micronutrient intake, and view a Diabetes Risk Score and other health indicators based on the food you log.

DesiPlate is an informational tool. It is not a medical device, a diagnostic service, or a substitute for advice from a qualified healthcare professional. The information shown in the app, including the Diabetes Risk Score, vitamin and mineral estimates, glycemic load readings, and health insights, is provided for general educational and informational purposes only.

Always consult a qualified healthcare professional for medical decisions, diagnosis, or treatment. Do not use DesiPlate as a basis for ignoring or delaying medical advice you have received from a doctor.

Your Account

To use most features of DesiPlate, you need to create an account. You can sign up with an email address, or you can sign in using Apple or Google.

You are responsible for keeping your account credentials secure. You agree to:

• Provide accurate information when you create your account
• Keep your password (or any sign-in credentials) confidential
• Notify us promptly if you believe your account has been accessed without your permission
• Not share your account with another person or allow another person to use it on your behalf

You are responsible for all activity that takes place under your account. If suspicious activity is detected on an account, we may temporarily restrict access while we investigate.

Beta Stage and Service Availability

DesiPlate is currently in a beta stage. This means certain things are still evolving:

• Features may be added, removed, or modified at any time
• Some features may not work as expected
• Performance may vary as the product is being developed
• Pricing, plans, and offers may change as the product moves out of beta
• Outages, maintenance windows, and temporary limitations may occur

We will make reasonable efforts to keep the Service available and to communicate significant changes. We do not guarantee uninterrupted availability or that every feature will always behave exactly as described in marketing materials.

By joining the beta, you understand and accept the early-stage nature of the product. We welcome your feedback to help us improve.

Subscriptions, Trials, and Payments

DesiPlate offers a free tier with limited features, and a premium subscription tier with additional features. Pricing is shown inside the app and may vary by region or platform.

Free trial. New users may receive a free trial period as displayed in the app at the time of signup. Beta members may receive additional bonus trial time on top of the standard trial. The exact length of the trial and any beta bonus is shown to you before you sign up.

Subscription billing. Subscription payments are processed by the Apple App Store on iOS and by the Google Play Store on Android. Billing is handled by the platform, not directly by us. The platform store will charge your selected payment method according to the plan you choose.

Automatic renewal. Subscriptions renew automatically unless you cancel them before the renewal date. You can cancel a subscription at any time directly from your Apple App Store or Google Play Store account settings.

Cancellation. When you cancel, you keep access to premium features until the end of the current billing period. After that, your account is downgraded to the free tier.

Refunds. Refund requests are handled according to the policies of the Apple App Store and Google Play Store. Because we do not process payments directly, we are generally unable to issue refunds ourselves. We may, in good faith, help facilitate refund requests in specific situations.

Pricing changes. We may change subscription pricing in the future. Existing subscribers will be notified in advance of any change that affects them.

Your Responsibilities

When using DesiPlate, you agree to:

• Use the Service for personal, non-commercial purposes only
• Not use the Service in any way that violates applicable law
• Not attempt to access another user's account
• Not interfere with the proper functioning of the Service
• Not use the Service to harm yourself or others
• Not upload content that is illegal, abusive, harassing, defamatory, or that infringes the rights of others
• Not submit false, misleading, or harmful content through any feature of the app, including community dish submissions, recipe sharing, or feedback forms

If you submit a dish, recipe, or other content to the public DesiPlate database (for example, through the community dish submission feature), you grant us a non-exclusive, royalty-free licence to use, store, display, and modify that content within the Service. You confirm that the content you submit is yours to share and does not infringe anyone else's rights.

Prohibited Activities

The following activities are not permitted on DesiPlate. They may result in account suspension, account termination, and where appropriate, reporting to legal authorities.

• Attempting to reverse engineer, decompile, or extract the source code of the app
• Attempting to bypass paywalls, free trial limits, or other access controls
• Using automated tools, bots, or scrapers to interact with the Service
• Probing, scanning, or testing the security of the Service without our prior written permission
• Sending spam, phishing, or unsolicited messages through any feature
• Uploading malware or any other harmful code
• Misrepresenting your identity or affiliation
• Using the Service to advertise or promote third-party products without our permission
• Attempting to interfere with another user's experience
• Any activity that is illegal under the laws of India or the laws of your country

Intellectual Property

All content, software, design, branding, logos, illustrations, and other materials that make up DesiPlate are owned by Lasyaa AI Tech Pvt Ltd or are used under licence. They are protected by copyright, trademark, and other laws.

You may use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from DesiPlate, in whole or in part, without our prior written permission.

You retain ownership of the personal content you create inside the app, such as your meal logs and your saved family recipes. By using these features, you give us the limited permissions needed to store, display, and process that content as described in the Privacy Policy.

Health Disclaimer

DesiPlate is an informational nutrition tool. It is not a medical device. The features in the app, including the Diabetes Risk Score, the vitamin D tracker, the iron and B12 indicators, the glycemic load estimates, and the health insights, are based on general nutritional information and should be treated as educational guidance only.

The Service does not:

• Diagnose any medical condition
• Replace advice from a doctor, dietitian, or other qualified healthcare professional
• Guarantee any specific health outcome

If you have a medical condition, are pregnant, are taking medication, or are considering changes to your diet for health reasons, please consult a qualified healthcare professional. Do not rely on DesiPlate for emergency or critical medical decisions.

If you ever feel unwell, please contact your doctor or local emergency services immediately.

Third-Party Services

DesiPlate relies on third-party services to operate, including cloud infrastructure, AI processing, subscription management, analytics, and crash reporting. These services have their own terms and policies. By using DesiPlate, you also accept the relevant terms of those third-party providers to the extent that they apply.

Where the Service links to or integrates with third-party content or services, we are not responsible for the content, accuracy, or practices of those third parties.

Limitation of Liability

To the maximum extent permitted by law, DesiPlate, Lasyaa AI Tech Pvt Ltd, and our employees and partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. This includes loss of data, loss of profits, business interruption, or any health-related decision you make based on information shown in the app.

Our total aggregate liability, where it cannot be excluded by law, is limited to the amount you paid to us in subscription fees in the twelve months preceding the event that gave rise to the claim, or one hundred Indian rupees, whichever is greater.

Nothing in these Terms is intended to limit any liability that cannot be limited under applicable law.

Indemnity

You agree to indemnify and hold harmless Lasyaa AI Tech Pvt Ltd and its team from any claim, loss, or expense (including reasonable legal costs) arising out of your misuse of the Service, your violation of these Terms, your violation of applicable law, or your infringement of the rights of any third party.

Termination

You can stop using DesiPlate at any time. You can delete your account from within the app, which will remove your personal data from our active systems within a reasonable period as described in the Privacy Policy.

We may suspend or terminate your access to DesiPlate if:

• You violate these Terms
• You misuse the Service
• We are required to do so by law
• Continued provision of the Service to you presents a risk to other users or to the integrity of the Service

Where reasonably possible, we will try to give you notice before suspending or terminating your account. In cases of serious abuse, fraud, or risk to others, we may act without prior notice.

Provisions of these Terms that by their nature should survive termination — such as intellectual property, health disclaimer, limitation of liability, and governing law — will continue to apply after termination.

Changes to These Terms

We may update these Terms from time to time as the product evolves. When we make material changes, we will update the "Last Updated" date at the top of the document and may also notify you through the app or via email.

Continued use of DesiPlate after the changes take effect means you accept the updated Terms. If you do not accept the changes, you should stop using the Service and may delete your account.

Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or your use of DesiPlate will be subject to the exclusive jurisdiction of the competent courts in India.

If you live in a country whose laws give you additional mandatory rights, those rights are not affected by this section.

We encourage you to contact us first if you have a concern, so we can try to resolve the matter directly before any formal dispute begins.

Miscellaneous

These Terms, together with the Privacy Policy, make up the complete agreement between you and us regarding your use of DesiPlate.

If any part of these Terms is found to be unenforceable, the rest of the Terms will continue to apply.

If we do not enforce a particular right at a particular time, that does not mean we have waived our ability to enforce it later.

You may not assign these Terms to anyone else without our prior written permission. We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, or sale of the business.
